China Unveils Draft AI Export Controls: Model Weights and Autonomous Agents Face Registration

Strategic Technology Export Catalogue Adjustments

China's Ministry of Commerce (MOFCOM), in coordination with the Ministry of Science and Technology, issued proposed revisions to the Catalogue of Technologies Prohibited and Restricted from Export on October 17, 2026. The regulatory proposal introduces 40 new technology classifications across three strategic industries: artificial intelligence, biomedicine, and photovoltaic systems.

Artificial intelligence forms the centerpiece of the update, accounting for 23 distinct technology categories. Chinese trade authorities are establishing strict export barriers covering large language models, autonomous agent frameworks, distributed computing clusters, and custom integrated circuit designs for AI data processing.

Weight Transfer Restrictions and the Two-Trillion Parameter Threshold

The regulatory framework establishes targeted restrictions on the cross-border transfer of model weights and proprietary source code. The proposal introduces explicit technical thresholds: models exceeding two trillion parameters, or systems demonstrating performance parity with global frontier systems, fall directly under restricted export licensing.

Domestic firms seeking to license, sell, or transfer model weights to foreign commercial entities must obtain joint ministerial clearance. The policy prevents the unauthorized export of proprietary model architectures funded through domestic enterprise and state research initiatives.

While the public consultation period remains open through November 15, 2026, MOFCOM instituted an immediate pre-export registration mandate effective upon publication. This interim procedure applies to all pending and newly initiated export filings.

Carve-Outs for Open-Source Repositories and Cloud APIs

The regulatory text differentiates between raw model asset transfers and standard software consumption. The framework exempts algorithms, architectures, and datasets already distributed through public open-source repositories and verified academic literature.

Standard cloud-delivered inference via web interfaces, application programming interfaces (APIs), and software-as-a-service platforms also remains unrestricted. Global developers and enterprise clients can continue interacting with hosted models remotely without triggering cross-border physical asset export filings.

National Security Priorities and Autonomous Threat Mitigation

Chinese authorities grounded the export controls in national security defense and automated threat prevention. Official guidance documents highlight risks tied to autonomous agents, including automated malware generation and unauthorized intrusions targeting critical public infrastructure.

The regulations position statutory export licensing as a legal mechanism to enforce human supervision over autonomous systems and protect national technical assets in international trade.
